Terms and Conditions

These terms and conditions document a legal agreement between the The Ray Helfer Society ("we" or "us") and the user ("you.") By accessing OBCAP, registering for a user account, or posting user content to OBCAP you indicate your acceptance of these terms and conditions. If you do not accept these terms and conditions, do not access OBCAP and email the site administrator to request that your account be cancelled.

Elligibility

You acknowledge that OBCAP is offered exclusively to members of the Ray Helfer Society. Access to EWD is limited to child protection professionals nominated by other users. You agree not to share your access credentials with others. You acknowledge that some of the content on OBCAP may be inappropriate for children and represent that you are at least 18 years of age.

Monitoring Disclosures

We disclose and you acknowledge that access to OBCAP may be monitored using cookies and Google Analytics. You consent to such monitoring. You acknnowledge that aggregate monitoring data may be included in academic publicationas regarding OBCAP.

Copyright

OBCAP is copyrighted by the The Ray Helfer Society. Quarterly content is copyrighted by The Ray Helfer Society and is used with permission. All intellectual property rights are reserved. Please do not duplicate or distribute content from OBCAP.

Similar to the Helfer Listserve we ask that you neither cite nor refer to content on OBCAP in court testimony or expert reports. Similarly, please do not cite or quote specific individuals who contribute to OBCAP. We definitely hope that OBCAP is useful in preparing these reports, just omit specific quotes or citations. Full text files on EWD are appropriate for use in court or reports.

OBCAP permits and encourages you and other users to contribute content to the site. Copyright for user contributed content is owned by the respective contributors. In consideration of our having posted your contribution on OBCAP you grant to John Melville, MD a nonexclusive but irrevocable license to publish, store, translate, adapt, and use your contribution forever, in all the world and in all media now existing or invented in the future.

OBCAP allows other users to edit content you contribute. By contributing to OBCAP, you consent to having your content edited by other users or the OBCAP administrator.

Do not post copyrighted materials to OBCP for which you are not the copyright owner. Content that violates copyright will be removed.. For more information, see the DMCA Copyright Policy.

Acceptable Use

We hope to host on OBCAP a robust and vibrant discourse regarding controversial topics. While all viewpoints are welcomed and encouraged, we ask for a respectful, collegial tone that would be appropriate for the website of a professional association.

Ad hominum, threats, and epithets are not appropriate on OBCAP. These will be removed when found by the administrator.

Limitation of Liability

While we hope that OBCAP will be useful, we cannot control the quality of content that users submit to our site. To the extent permitted by law, you agree that OBCAP, the Helfer Society, its staff, and other OBCAP ocntributors will not be liable to you for any damages, including incidental or consequential damages, related to your use of OBCAP.

Severability, Governing Law, and Venue.

If a provision of this agreement determined to be unenforcable by a court, the remaining provisions will continue in effect.

This agreement will be interpreted under the laws of the state of South Carolina. You agree that any litigation regarding this agreement will occur in the courts of Charleston County, SC.

Digital Millennium Copyright Policy

OBCAP does not intend to host copyrighted material that is not covered by a fair use exception. OBCAP complies with the Digitial Millennium Copyright Act which provides an alternative to litigation to resolve claims of copyright infringement.

Copyright owners may submit a DMCA notice of infringement to the designated takedown agent, listed below. Email contact is preferred. A notice of infringement must contain:

  1. A clear indication of the copyrighted work(s) claimed to have been infringed.
  2. A clear indication of the content on OBCAP that is claimed to infringe the copyright. The best way to provide this information is to reproduce the complete URL, or to use the "Flag This Page" link on every page of OBCAP.
  3. A statement that the submitter has a "good faith belief that the material that is claimed as copyrighted infringement is not authorized by the copyright owner, its agents, or the law."
  4. A statement that "the information in the notification is accurate, and under penalty of perjury, the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  5. A physical address, email address, and phone number of the sender so we can respond to your notice.

You may want to consult with a laywer before filing a DMCA notice of infringement. Please note that Section 512(f) of the Copyright Act provides that any person who knowingly misrepresents that material infringes a copyright may be subjected to civil liability.

Following reciept of a complete notice of infringement the takedown agent will take down, or disable access to, the alleged infringeing content. The agent will notify the user who posted the allegedly infringeing content of the takedown notice.

If you believe that your content was taken down inappropriately you may email a counter notice to the takedown agent. A counter-notice must contain:

  1. A specific indication of the content which we have removed.
  2. Your full name, address, telephone number, and email address.
  3. A statement that you will submit to the jurisdiction to the Federal District Court where your address is located, or the Federal Court District encompassing Charleston, SC if you are located outside of the United States.
  4. A statement that you will accept service of process from the party alleging copyright infringement or their agents.
  5. The following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed as a result of a mistake or a misidentification of the material to be removed.

You may want to consult with a laywer before filing a DMCA counter-notice. Please note that Section 512(f) of the Copyright Act provides that any person who knowingly misrepresents that material was deleted by mistake or due to a misidentification may be subjected to civil liability.

The takedown agent will provide the counter-notice, including personal identifying information contained therein, to the complaining party. If the complaining party does not notify us within 10 days that they are filing suit to enjoin publication of the alleged infringing material, we may restore the content to OBCAP.

OBCAP may include links to websites outside of OBCAP. These third-party sites have separate and independent privacy policies. We offer no warranty regarding the content and activities of these linked sites. Feedback regarding problems you experience at sites to which OBCAP links is welcome.

OBCAP uses Google analytics to measure site performance and user activity.

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under the age of 13 years old, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States' consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.

We do not specifically market to children under the age of 13 years old. Usage of OBCAP is strictly limited to members of the Helfer Society and other professionals. Any members qualifying for Helfer membership prior to the age of 13 will, upon verification of age, receive from the website administrator a free (but nonalcoholic) drink of their choice at the following annual meeting.
